I filed chapter 7 bankruptcy in ohio? do i ... - Finance Talking Hub

I just filed a week ago. my lawyer said not to pay anything including utilities. Is he right?

I've heard otherwise.

He should be faxing a copy of your bankruptcy to the utility companies. you should not owe anything before your filign date. example. if you had a 1000 gas bill and you filed,, then anything used prior to your filing date will be wiped away. you will just have to pay for your current bills. also, you can call the utility companies yourself but be prepared to give them your case number. The attorney's secretary should be able to fax them your info if you call her.

And yes, you can include past due utilities in bankruptcy.

A bankruptcy is a federal court action. you are relieved of paying some debts that you have accumulated. you are not supposed to accumulate new "debts" during the bankruptcy. So you are supposed to pay your rent or your mortgage; pay for your car note if you want to keep the car; pay for your utilities during the bankruptcy. It is possible that some previous utility bills will be wiped-out by the BK; that is what your attorney is telling you not to worry about.

He is incorrect, utilities have to be paid no matter what. I don't think that you can include utilities in a bankruptcy. When I went through a chapter 7 years ago I still had to make utility payments along with payments towards debts that I was reaffirming like my car.

You can stop paying your utilities, then they will turn them off. you may be able to get back-payments discharged.

why did you hire an atty if you did not take professional advice?
